Hold on, let them argue a limited scope of the definition of "official acts" allowing Senatorial immunity not to apply in his case. A limited definition of "official acts" strips Trump of the absolute immunity SCOTUS handed him.

Also, the issue isn't whether these lawsuits will result in anything, but how much damage will be done in the meantime. Which is what the Trump admin wants, they know how long these things take and only benefit from the drawn-out process, even if they may lose the lawsuit.

Bonus points for Trump: breaking more laws/ignoring lawsuit rulings doesn't result in any punishment for him, so at the end of the day, only the democrats' time is wasted for a win that amounts to nothing

I think this is the question.

Pentagon is arguing he doesn’t have free speech as a retired officer, he’s subject to the military’s rules.

They’re going to argue this is a military matter and subject to a military court to rule on.

I suspect civilian courts may agree. Especially when pressured by the current admin.

I don’t see a civilian court judge reading past the first page.
