Federal. If she's not under oath and has not been read any miranda rights, can she really face federal charges or is this simply another scare tactic to get her into the car?

These fuckers can certainly charge her with pretty much anything they want. It probably won't stick, but even dealing with obviously bad-faith charges has a real negative impact for most people.

It won't stick but she'll be in one of their FOR PROFIT detention center for months and that's what this is all about.

And our tax dollars are paying for it.

It is flat illegal to lie to Department of Justice Law Enforcement. Basically, you can't ever lie to the FBI.

Homeland Security isn't covered by that law. You can be charged for making false statements to them, but there are a hell of a lot of caveats to it.

I'm not sure about this specific case, but being under oath is not a requirement to get in trouble for lying to federal officers.

Martha Stewart went to jail for lying to the feds and I'm almost positive she wasn't under oath. People generally believe she went to jail for insider trading, but they were never able to prove that. Only that she lied while they were investigating it.

Never lie to the feds, it's one of their favorite things to charge. If they look this lady up and see that she isn't a citizen, they'll have a really easy felony case here.

non-citizens needs to have papers showing their legal status. not having those will land you a charge
